Definition: Copyright is a legal right given to the creator of original literary, dramatic, musical, and artistic works, and producers of cinematograph films and sound recordings.

Simple Terms: If you create something (write a book, compose a song, make a film), copyright protects it from being copied without your permission.


What is Protected by Copyright? 📚

  1. Literary Works: Books, poems, articles, computer programs.
  2. Dramatic Works: Plays, scripts.
  3. Musical Works: Songs, compositions.
  4. Artistic Works: Paintings, sculptures, photographs, architecture.
  5. Cinematograph Films: Movies, videos.
  6. Sound Recordings: Music albums, podcasts.

Indian Example: When R.D. Burman composed "Dum Maro Dum", he owned the copyright. No one could re-record it without permission (or paying royalty).


Rights of Copyright Owner 🛡️

Economic Rights (Make Money):

  1. Reproduce the work (Make copies).
  2. Distribute to public (Sell books/CDs).
  3. Perform publicly (Concert, play).
  4. Communicate to public (Broadcast on TV/Radio).
  5. Translate to other languages.
  6. Adapt (Make movie from book).

Moral Rights (Respect):

  1. Right of Paternity: To be recognized as the author.
  2. Right of Integrity: Work should not be altered/distorted to harm reputation.
Moral Rights Cannot Be Transferred

Even if you sell copyright to a publisher, you still retain moral rights.

Example: If JK Rowling sells Harry Potter copyright, the buyer can print and sell books, but they MUST still credit her as the author. They cannot change the story to show Harry as a villain (harms her reputation).


Duration of Copyright Protection ⏳

In India (Copyright Act, 1957):

Copyright Registration 📝

Important: Copyright exists automatically from the moment of creation (No registration needed).

But Registration is Helpful:

  • Proof of ownership (In court cases).
  • Public record.
  • Easy to license or sell.

Where to Register: Copyright Office (Under Ministry of Commerce, Govt of India).
