The TRIPS Agreement links intellectual property rights (IPRs) with world trade.

1. Meaning / Background

TRIPS (Trade-Related Aspects of Intellectual Property Rights) is a WTO agreement that sets minimum standards for protection and enforcement of IPRs (patents, trademarks, copyrights, etc.) in all member countries.

  • Part of WTO package from Uruguay Round.
  • Aims to reduce distortions and impediments to international trade caused by different IPR standards.

2. Key Provisions of TRIPS (4–6 Points)

  1. Minimum Standards for IPR Protection

    • Members must provide patent protection for at least 20 years for inventions in all fields of technology (with limited exceptions).
  2. National Treatment and MFN

    • Foreign nationals must be given treatment no less favourable than domestic nationals (national treatment).
    • Benefits given to one WTO member must be extended to all (MFN).
  3. Enforcement Procedures

    • Members must provide effective legal remedies against IPR infringement (civil, administrative, criminal where appropriate).
  4. Transitional Periods for Developing Countries

    • Longer time given to implement TRIPS obligations; special provisions for least developed countries (LDCs).
  5. Flexibilities – Compulsory Licensing, Parallel Imports

    • Under certain conditions, governments may issue compulsory licences (e.g., for public health) or allow parallel imports.

3. TRIPS and India – Pharmaceutical Sector Example
