What is Cyber Law?

Definition: Cyber Law (also called Internet Law or IT Law) is the legal framework that governs activities in cyber space - including electronic transactions, data protection, cyber crimes, and digital rights.

Scope of Cyber Law

1. E-Commerce & Online Transactions

Regulates:

  • Online contracts (terms & conditions)
  • Digital payments (UPI, credit cards)
  • Consumer protection
  • Refund policies

Example: If Flipkart doesn't deliver your order, Consumer Protection Act + IT Act apply!

2. Data Protection & Privacy

Covers:

  • How companies collect your data
  • Storage and usage of personal data
  • Right to be forgotten
  • Data breach penalties

India's Law: Digital Personal Data Protection Act, 2023 (recently passed!)

3. Cyber Crimes

Includes:

  • Hacking, phishing, ransomware
  • Identity theft, cyber stalking
  • Online fraud, child pornography
  • Cyber terrorism

Penalties: As covered in Chapter 4 (imprisonment + fines)

4. Intellectual Property Rights (IPR) Online

Protects:

  • Domain names

Example: Downloading pirated movies from Torrent sites = ₹2 lakh fine + 3 years jail!

  • Income tax e-filing
  • Online government services (UMANG, DigiLocker)
  • Electronic records as legal evidence

6. Telecommunication & Internet Regulation

Includes:

  • Internet service providers (ISPs) responsibilities
  • Blocking illegal websites
  • WhatsApp, Facebook regulation
  • Net neutrality

7. Freedom of Speech vs Hate Speech

Balances:

  • Right to express opinions online
  • vs Preventing hate speech, defamation
  • Fake news regulation

Why Do We Need Cyber Law?

  • No recourse, seller disappeared
  • Lost money
